Man Shot by ICE in the U.S. Legally, Lawyer Says

Wilber Rafael Garces Perez, the 28-year-old Venezuelan immigrant shot by a U.S. Immigration and Customs Enforcement agent in North Austin on Sunday, is in the U.S. on a valid work permit, his attorney

Kate Lincoln-Goldfinch said. Garces Perez entered the country lawfully through a probation program seeking asylum, she said.

  • Garces Perez is being held in a detention center in Pearsall. He was being treated at Dell Seton Medical Center before being taken to Pearsall, which is southwest of San Antonio. Garces Perez told his attorney that the bullet is still lodged in his back, he is not being given any pain medication and was not given a bed, Lincoln-Goldfinch said. His wife has also not been able to speak with him.
  • Garces Perez was doing DoorDash deliveries. The 28-year-old Venezuelan immigrant was making DoorDash deliveries when he encountered ICE near U.S. 183 in North Austin. Agents were running license plates in the area and found Garces Perez had a deportation order. He was not the target of a federal investigation. A law enforcement official told the New York Times that Garces Perez left the area in his car when he was told he would be arrested. [The New York Times]
  • An unmarked van hit Garces Perez. Lincoln-Goldfinch said that an unmarked black van sideswiped Garces Perez’s vehicle, causing him to do a U-turn under U.S. 183 as he did not know ICE agents were in the van. The van then chased Garces Perez. Lincoln-Goldfinch said no foot chase occurred and she has video evidence to that fact. Congressman Greg Casar said Garces Perez has no criminal record.
  • Garces Perez was cuffed with a gunshot wound. Video of the shooting shows Garces Perez being handcuffed as he’s moved to sit on a curb. A bullet wound in his back below the nape of his neck is seen bleeding in the video. [Austin American-Statesman]

Austin Cat Killed by a Waymo, Family Says

An Austin family is asking Waymo to donate to an animal rescue and pay for their cat’s $1,000 vet bill after the pet was struck by one of the autonomous vehicles earlier this month. The cat, whose name was Tommy, was hit after running out into the street and suffered a broken back and trauma to one of his limbs. [Austin American-Statesman]

Terrible Love Wine has opened next door to its coffee counterpart, Terrible Love, at the old Baker School in Hyde Park. The spot is open daily and has a food menu that includes cheese plates, bread and jam, and tinned fish. [Austin Monthly]

2 Local H-E-Bs Are Getting Upgrades

H-E-B is pouring more than $500,000 into Curbside upgrades at its East 51st Street and South Congress Avenue stores. Construction is scheduled to start Nov. 9 with a completion date in April. [mySA]
